Examples of Courtesy Overdraft Protection
There are many examples of Courtesy Overdraft Protection, what is important is to understand is you may be charged an overdraft fee on a transaction that you initiate when you don't have enough money in your account to cover that transaction.
For example: Suppose you forgot that you only had $45 in available balance in your checking account and you wrote a check for $75. Your account would be overdrawn by $30. With our Courtesy Overdraft Protection, we may, at our discretion authorize and pay that item, which will result in a $32 overdraft fee. Your check would be paid and you would avoid the inconvenience of the check not being paid and also avoid any merchant fees usually charged when a check doesn't clear.

What you need to know about Overdrafts and Overdraft Fees
An overdraft occurs when you do not have enough money in your account to cover a transaction, but we pay it anyway. We can cover your overdrafts in two different ways:
- We have standard overdraft practices that come with your account.
- We also offer overdraft protection plans, such as a link to a savings account, which may be less expensive than our standard overdraft practices. To learn more, ask us about these plans.
What are the standard overdraft practices that come with my account?
We do authorize and pay overdrafts for the following types of transactions:
- Checks and other transactions made using your checking account number
- Automatic Bill Payments
We do not authorize and pay overdrafts for the following types of transactions unless you ask us to (see below):
- ATM transactions
- Everyday debit card transactions
We pay overdrafts at our discretion, which means we do not guarantee that we will always authorize and pay any type of transaction. If we do not authorize and pay an overdraft, your transaction will be declined.
What fees will I be charged if First American Bank pays my overdraft?
Under our standard overdraft practices:
- We will charge you a fee of $32 each time we pay an overdraft.
- Also, we charge $25 for every five or more consecutive days your account is overdrawn.
What if I want First American Bank to authorize and pay overdrafts on my ATM and everyday debit card transactions?
If you also want us to authorize and pay overdrafts on ATM and everyday debit card transactions you must OPT-In by completing a Customer Response Form at any of our banking centers or contact a customer service representative.
Courtesy Overdraft Protection Disclosure
First American Bank offers Courtesy Overdraft Protection for the following eligible checking accounts:

- FIRST Freedom Club Checking
- FIRST Start Student Checking
- NOW Checking
It is the policy of First American Bank (”we") to comply with applicable laws and regulations, and to conduct business in accordance with applicable safety and soundness standards. First American Bank offers Courtesy Overdraft Protection for checks and automatic or recurring electronic payments on your account. Courtesy Overdraft Protection is a discretionary service that will apply to transactions that you initiate. Courtesy Overdraft Protection is not a line of credit or a guarantee that your overdrafts will be paid.
A non-sufficient funds (NSF) and/or overdraft (OD) (negative) balance may result from:
A) The payment of checks, electronic funds transfers, or other withdrawal requests;
B) Payments authorized by you;
C) The return, unpaid, of items deposited by you;
D) Our Fees/Charges;
E) The deposit of items which according to our Funds Availability Policy, are treated as not yet "available" or finally paid.
Categories of transactions: A fee of $32.00 may be imposed for covering overdrafts created by check, in-person withdrawal, ATM withdrawal, or other electronic means. We are not obligated to pay any item presented for payment if your account does not contain sufficient collected funds. Rather than automatically returning, unpaid, any non-sufficient funds items that you may have, if your eligible account has been open at least thirty (30) days and thereafter you maintain your account in good standing, which includes at least: (A) Continuing to make deposits consistent with your past practices, (B) You are not in default on any loan obligation to us. (C) You bring your account to a positive balance (not overdrawn) at least once every thirty (30) days, and (D) Your account is not the subject of any legal or administrative order or levy, we will consider, without obligation on our part, approving your reasonable overdrafts; as a purely discretionary overdraft service.
Circumstances for non-payment: Whether your overdrafts will be paid is discretionary by First American Bank and we reserve the right not to pay. For example, we typically do not pay overdrafts if your account is not in good standing, or you are not making regular deposits, or you have too many overdrafts.
We may refuse to pay an overdraft for you at any time, even if your account is in good standing and even though we may have previously paid overdrafts for you. You will be notifed by mail of any non-sufficient funds items paid or returned that you may have; however, we have no oligation to notify you before we pay or return any item. The amount of any overdrafts plus any NSF and/or OD Fee(s) that you owe us shall be due and payable upon demand. If there is an overdraft paid by us on an account with more than one (1) owner on the signature card, each owner, and agent if applicable, presenting the item creating the overdraft, shall be jointly and severally liable for such overdrafts plus any NSF and/or OD Fee(s).
Fees: This discretionary service will generally be limited to a $400 up to $700 overdraft (negative) balance for eligible personal checking accounts, depending on the type of account. Any and all fees and charges, including without limitation our NSF and/or OD Fee(s) of $32.00 per item and $25.00 fee for every five (5) consecutive days overdrawn will be included in this limit and will apply to any transaction that may overdraw your account (see "Eligible Account and Transaction Types"). There is a maximum of six (6) NSF and/or OD Fee(s) that may be charged per calendar day.
Limitations: Savings Type Accounts, Money Market Accounts, Public Fund/Charitable Organization Accounts, Student Minor Accounts, and Other Minor Accounts (not of legal age) are not eligible. We may limit the number of accounts eligible for Courtesy Overdraft Protection to one account per household and/or one account per taxpayer ID.
Eligible Account Types: The account types that are eligible for Courtesy Overdraft Protection are: First Rewards Checking, First Choice Checking, Personal Checking, First Start Student Checking, First Freedom Club, and NOW Checking.
Eligible Transaction Types: Each transaction/item initiated for payment against your checking account(s) may be processed by us using your assigned Courtesy Overdraft Protection limit, including without limitation: Checks, ACH, Electronic Items, our ATMs, foreign ATMs / Debit Card / Check Card, Internet/Online Banking (bill payment), and Telephone Banking transactions.
Optional Overdraft Protection Plans: You may link a designated savings account to your checking account to cover your overdrafts or apply for a line of credit through our 1ST Optimum Line of Credit to cover overdrafts. If you qualify for these services, they may provide less expensive options to cover your overdrafts and you may save money on the fees/charges you pay us for overdraft protection.
Customer OPT-In: If you want First American Bank to authorize and pay overdrafts on ATM and everyday debit card transactions, you may OPT-In by completing a Customer Response Card at any of our banking centers or by notifying one of our customer service representatives.
Customer OPT-Out: You may choose at any time not to participate in our Courtesy Overdraft Protection by notifying one of our customer service representatives.
If You Need Help: Overdrafts should never be used to finance ordinary or routine expenses - and you should not rely on overdrafts to cover these expenses. If at any time you feel you need help with your financial obligations please visit one of our banking centers or by calling Customer Care at 800-289-6140.

Nor does it constitute an actual or implied obligation of ours or by us. This service represents a purely discretionary privilege or courtesy that we may provide to you from time to time and which may be withdrawn or withheld by us at any time; without prior notice or reason or cause.
